Welcome to Nomad Auto Pro. These Terms and Conditions ("Terms") govern your access to and use of www.nomadautopro.com (the "Site") and the purchase of any products or services offered by NUVYON LLC doing business as Nomad Auto Pro ("we", "us", "our").
By accessing the Site or purchasing a product, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. GENERAL CONDITIONS & ELIGIBILITY
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including but not limited to traffic and vehicle safety laws). We reserve the right to refuse service to anyone for any reason at any time.
2. ACCURACY, PRICING, AND PRODUCT INFORMATION
We strive to ensure all product descriptions, images, and pricing are accurate. However, errors may occur.
Pricing: Prices for our products are subject to change without notice. We reserve the right to modify or discontinue a product at any time.
Typographical Errors: In the event a product is listed at an incorrect price due to a typographical error or an error in pricing information received from our suppliers, we reserve the right to refuse or cancel any orders placed for the product listed at the incorrect price, regardless of whether the order has been confirmed and your credit card charged. If your credit card has already been charged, we will immediately issue a full refund.
3. BILLING AND ACCOUNT INFORMATION
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.
Fraud Prevention & Chargebacks: We take friendly fraud and unjustified chargebacks strictly. By making a purchase, you agree that you will not initiate a chargeback with your credit card issuer for validly delivered products. Any fraudulent chargebacks will be prosecuted to the fullest extent of the law, sent to a third-party collections agency, and reported to major credit bureaus.
4. SHIPPING, RETURNS, AND RISK OF LOSS
All purchases of physical items from Nomad Auto Pro are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier (FOB Origin). For detailed procedures, please review our official Shipping Policy and Refund and Returns Policy, which are incorporated into these Terms by reference.
5. ASSUMPTION OF RISK & INSTALLATION DISCLAIMER
Nomad Auto Pro sells heavy-duty aftermarket automotive accessories (including but not limited to roof racks and tents).
User Responsibility: You acknowledge and agree that the installation, modification, and use of aftermarket auto parts carry inherent risks. You assume all responsibility for ensuring that the products are compatible with your vehicle and are installed properly according to manufacturer specifications.
No Liability for Installation: Nomad Auto Pro and NUVYON LLC shall not be held liable for any damage to your vehicle, third-party property, personal injury, or death resulting from improper installation, misuse, overloading, or modification of the products. We strongly recommend professional installation for all heavy-duty overland gear.
6. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL PRODUCTS SOLD THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
IN NO CASE SHALL NUVYON LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE PRODUCTS PROCURED USING THE SITE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.
7. DISPUTE RESOLUTION: MANDATORY ARBITRATION AND CLASS ACTION WAIVER
Please read this section carefully. It affects your legal rights.
Arbitration: Any controversy or claim arising out of or relating to these Terms, or the breach thereof, or your purchase of products from us, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitration shall take place in Cheyenne, Wyoming.
Class Action Waiver: YOU AND NUVYON LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
8. GOVERNING LAW
These Terms and any separate agreements whereby we provide you services or products shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
9. SEVERABILITY
In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.
